Terms of service
Last updated: June 2026
These terms govern your use of Websitebuilder, a website builder for nurseries provided by Famly. By creating an account or publishing a site you agree to them.
1. Who can use Websitebuilder
Websitebuilder is for nurseries, childminders and early-years settings, or the people acting on their behalf. You must be at least 18 to create an account and you are responsible for keeping your login details secure.
2. Your content, your site
You own your site. All the text, photos, branding and other content you put into your nursery site stays yours. Famly does not claim ownership of any content you upload. You grant Famly the permissions we need to host, display and back up that content so the service works — nothing more.
Famly owns the Websitebuilder software, templates, designs and platform itself. You're free to use the result; you can't take the underlying builder away with you.
3. Acceptable use
- Don't upload anything illegal, hateful, deceptive, or that infringes someone else's rights.
- Don't impersonate another nursery, organisation or person.
- Children's images: only upload photos of children if you have written parental consent. Nurseries are the data controller for those images — see our privacy policy for details.
- Don't attempt to break, overload or reverse-engineer the service.
We may take down content or suspend accounts that breach these rules.
4. Publishing and unpublishing
When you publish your site it becomes publicly visible at the URL you choose. You can unpublish at any time from your dashboard — the public link stops working within seconds and your draft stays safe in your account.
5. Service availability
Websitebuilder is provided "as is" on a best-effort basis. We aim for high uptime but don't guarantee uninterrupted service. Planned maintenance, third-party outages or incidents may occasionally take the service offline.
6. Termination
You can delete your account at any time — doing so removes your site, draft and any uploaded media from our backend. We may terminate accounts that breach these terms or that have been inactive for an extended period, after reasonable notice.
7. Liability
To the extent permitted by law, Famly is not liable for indirect or consequential loss arising from your use of Websitebuilder, and our total liability for any claim is limited to the fees you have paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be excluded by law.
8. Governing law
These terms are governed by the laws of Denmark, where Famly is headquartered, unless a different mandatory law applies to you as a consumer in your country of residence.
9. Changes
We may update these terms from time to time. Material changes will be announced in the dashboard or by email before they take effect.
